ELIBILITY: The [Playboy Mansion Giveaway] is open to legal residents of the fifty (50) United States who are eighteen (18) years of age and older as of their date of entry. Employees, officers and directors of Ecko Unltd., with its principal place of business at 40 West 23rd Street, New York, NY 10010, its affiliates, representatives, agents and website administrators and individuals residing in their same household as the foregoing are not eligible to enter the [Playboy Mansion Giveaway].
HOW TO ENTER: To enter the [Playboy Mansion Giveaway] visit marcecko.com/playboy, complete on-screen instructions to register (if you have not done so previously) and to submit your entry. Participant must provide their first and last name and valid e-mail address in order to be eligible for a chance to win. Entry requirements must be completed and entry received no later than 11:59 p.m. ET on January 3, 2010. Online entries generated by robotic, automatic, macro, programmed or other mechanical or other automated means are void. Limit one (1) entry per person and per account. Multiple entries from the same person shall be in violation of this rule and will be declared ineligible. Sponsor shall resolve all disputes as to identity of the winner who enters on the basis of the identity of the registered user of the email account, and if a prize is won by such entry, the registered user of such email address shall be awarded the applicable prize.
GRAND PRIZE: One (1) Grand Prize winner will receive a trip to Los Angles, California (“Trip”), [at a mutually agreed time between Sponsor and grand prize winner]. Trip must be completed by October 1, 2010. Trip includes round trip air transportation for two (2), including Grand Prize winner and a guest from the closest major airport, and hotel accommodations for two (2), based on double occupancy, for two (2) nights. Grand Prize also include a visit to and private tour of the Playboy Mansion. Hotels shall be selected at Sponsor’s sole discretion. grand prize winner and guest must fly on same itinerary. The approximate retail value for the Grand Prize is Two Thousand Dollars (US$2,000). Actual value of trip depends on the date, time and other factors of final itinerary. Grand Prize is non-transferable. Ecko Unltd. reserves the right to substitute the Grand Prize, or any portion thereof, for a prize of equal or greater value, in its sole discretion.
PRIZE RESTRICTIONS: Grand Prize winner and guest must be able to travel to Los Angles, California on Friday and return on the following Sunday. Travel restrictions and black out dates may apply. All other expenses and costs not set forth herein are the sole responsibility of the winner. The winner is responsible for any and all applicable federal, state, local and international taxes. Additional restrictions may apply. Guest must be eighteen (18) years of age or older, unless traveling with a parent or guardian.
Attendance at the Playboy Mansion is subject to the further restrictions of Playboy Enterprises, Inc. The [Playboy Mansion Sweepstakes] is not endorsed or approved by, affiliated with or sponsored by Playboy Enterprises, Inc.
SELECTION OF GRAND PRIZE WINNER: A random drawing for the Grand Prize will be conducted on or about January 15, 2010 by the Sponsor whose decision is final and binding in all matters related to the [Playboy Mansion Giveaway]. Odds of winning the Grand Prize depend on the number of eligible entries received. The potential winners will be notified by e-mail and/or telephone. If a potential winner cannot be contacted or does not respond within seven (7) days after the first attempt to contact such potential winner, an alternate entrant will be selected in his or her place at random from among all eligible entries received.
CONDITIONS RECEIPT OF PRIZE: Grand Prize winner will be required to sign, notarize and return Sponsor’s Affidavit of Eligibility/Release of Liability Form and IRS-W9 Form. Guest will be required to sign, notarize and return Sponsor’s Affidavit of Eligibility/Release of Liability Form. In the event that a winner or guest does not properly return the Affidavit of Eligibility/Release of Liability Form or IRS W9 Form within seven (7) days following receipt, a disqualification will result and Sponsor may choose an alternate winner from among all remaining eligible entries.

GENERAL CONDITIONS: Each entrant agrees to release and hold Sponsor and its employees, officers, directors, parents, subsidiaries, shareholders, representatives, agents, advertising agencies, and website administrators harmless from and against any and all losses, damages, rights, claims, and actions of any kind arising in connection with the [Playboy Mansion Giveaway] or resulting from acceptance, possession, or use of the Grand Prize, including but not limited to personal injury, death, and property damage as well as claims based on publicity rights, defamation, or invasion of privacy. Sponsor and the person or entities involved with providing an entrant internet access are not responsible for incorrect, inaccurate or garbled entry information, human error, technical malfunctions, viruses, lost/delayed data transmission, omission, interruption, deletion, defect, network failures, computer equipment failure, software errors, or any combination thereof, inability to access the Sponsor's website, printing errors or late, lost or incomplete entries.
SPONSOR AND PLAYBOY ENTERPRISES, INC., AND THEIR RESPECTIVE EMPLOYEES, OFFICERS, DIRECTORS, REPRESENTATIVES, AGENTS AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE [PLAYBOY MANSION GIVEAWAY]. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU; IN SUCH JURISDICTIONS, THE POTENTIAL LIABILITY OF THE SPONSOR WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
PRIVACY: Sponsor respects the privacy of its participants. Information collected in connection with the [Playboy Mansion Giveaway] will be used in accordance with these Official Rules and the Privacy Policy of the Ecko Unltd. website. By accepting the Grand Prize, the winner agrees that the Sponsor may use the winner's name, picture/portrait likeness and/or voice, for advertising and promotional purposes without further consideration, unless prohibited by law.
NON-INTERFERENCE: Any attempt to deliberately damage the content or operation of the [Playboy Mansion Giveaway] is unlawful and subject to legal action by the Sponsor. Sponsor shall have the sole right to disqualify any contestant for violation of these rules or any applicable laws relating to the [Playboy Mansion Giveaway], and to resolve all disputes in their sole discretion.
MISCELLANEOUS: All entries become the sole property of Sponsor and will not be returned. A potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.
Each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the [Playboy Mansion Giveaway] or any prize awarded shall be subject to the exclusive jurisdiction of federal and state courts located in New York County, New York. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, entrant's rights and obligations hereunder, or the rights and obligations of the Sponsor in connection with the [Playboy Mansion Giveaway], shall be governed by, and construed in accordance with, the laws of State of New York, without giving effect to the principles of conflicts of laws.
If, for any reason, the [Playboy Mansion Giveaway] is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupts or affects the administration, security, fairness, integrity or proper conduct of this [Playboy Mansion Giveaway], Sponsor reserves the right to terminate the [Playboy Mansion Giveaway].
